• Age Restriction: You must be at least 16 years old to buy products on our site. To register as a Vendor and sell products, you must be at least 18 years old (or the age of legal majority in your jurisdiction) to legally enter into a binding contract and receive payments.

• Modifications to the Terms: Tons of Tones reserves the right, at our sole discretion, to modify, update, or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice (e.g., via a website banner or email) prior to any new terms taking effect. By continuing to access or use our marketplace after those revisions become effective, you agree to be bound by the revised Terms.

2. Buying Products

• Guest Checkout: You do not need to register an account to make a purchase. You may purchase products as a guest.

• License to Use: When you buy a preset, tab, or IR, you are granted a personal, non-exclusive license to use the product. You are strictly prohibited from sharing, redistributing, or reselling the files. Please respect the creators’ effort.

• Refund Policy: Please refer to our Refund Policy for detailed information regarding our return and refund guidelines for digital products.

• Data Backup: It is your sole responsibility to back up any files you purchase and download. We do not guarantee that purchased files will remain available for download indefinitely. Please save your files to your local drive immediately after purchase.

3. Selling Products (Vendor Terms)

By listing and selling products on Tons of Tones, you agree to the following financial and operational terms:

• Revenue Sharing: Tons of Tones operates on a revenue-sharing model. For every product sale, a 15% platform fee will be deducted from the total sale price. Which ensures the seller is guaranteed an 85% net return from the total transaction. The 15% platform commission is comprehensive and absorbs all external processing fees, ensuring the seller receives their full 85% share without any further deductions.

• All-Inclusive Platform Costs: Tons of Tones covers all operational costs associated with the transaction, including PayPal payment processing fees, currency conversion fees, platform maintenance, hosting, and marketing promotion.

• Net Earnings: As a Vendor, you will receive 85% of the sale price as your net revenue.

• Payout Schedule: Payouts are processed automatically on the 15th of each month.

• Payout Threshold: Payouts are issued only to Vendors who have reached a minimum accumulated balance of $30.00 USD. If your balance is below this threshold, your earnings will carry over to the next month until the threshold is met.

• Payment Method: Payouts are made directly to the PayPal account provided by the Vendor in their account settings. It is the Vendor’s responsibility to ensure their PayPal details are accurate and up to date.

• Large File Hosting (Courses and Video Content): To maintain optimal marketplace performance, Vendors selling large digital products, such as video courses or extensive sample libraries, are not permitted to upload these heavy files directly to our servers. Instead, you must host these files on a secure external cloud service (e.g., Google Drive, Dropbox) and provide the Buyer with a PDF or text document containing the accessible download link upon purchase.
• Copyright and Intellectual Property (IP): By uploading and listing products on Tons of Tones (including but not limited to backing tracks, tabs, impulse responses, and presets), you, as a Vendor, represent and warrant that you own all necessary rights, licenses, and permissions to sell and distribute such content. If your product is a derivative work or based on existing copyrighted material (e.g., songs by known artists), it is your sole responsibility to ensure you are legally permitted to monetize it. Tons of Tones respects intellectual property rights and complies with standard copyright laws (including the DMCA). If we receive a valid copyright infringement claim regarding your listing, we reserve the right to remove the product immediately and without prior notice. You agree that any legal liability, damages, or disputes arising from copyright infringement are strictly your responsibility, and you agree to fully indemnify and hold Tons of Tones harmless from any such claims.
• Tax Responsibility: As a Vendor on Tons of Tones, you operate as an independent contractor. The payouts you receive from us represent your net earnings after the platform fee is deducted. You are exclusively responsible for calculating, reporting, and paying any and all applicable taxes associated with your earnings including but not limited to income tax, Value Added Tax (VAT), sales tax, or any other local duties to the relevant tax authorities in your jurisdiction. Tons of Tones acts solely as a marketplace facilitator; we do not withhold taxes from your payouts (unless legally required to do so by Israeli law) and we assume no responsibility or liability whatsoever for your individual tax obligations.
• Inactive Accounts and Unclaimed Funds: If a Vendor account remains completely inactive (no logins, no sales, no new uploads) for a period of twelve (12) consecutive months, and the accumulated balance is below the minimum payout threshold ($30.00 USD), or if the Vendor has provided an invalid PayPal address resulting in failed transfers, Tons of Tones reserves the right to absorb the remaining balance as an administrative maintenance fee and permanently close the account.
• Indemnification: You agree to indemnify, defend, and hold harmless Tons of Tones, its owner, affiliates, and partners from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable legal fees and costs, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your infringement of any third-party rights.

4. Account Termination

We reserve the right to suspend or terminate your account and refuse use of the Site without prior notice if you violate these Terms. If a Vendor account is terminated due to fraudulent activity or violation of these terms, we reserve the right to withhold any unpaid earnings.

By creating an account (either as a Buyer or a Vendor), you grant our site administrators the explicit right to access your account dashboard and data. This access is strictly used for platform maintenance, customer support, and administrative purposes such as processing and verifying your monthly payouts, auditing transactions, and resolving technical issues.

5. Trademarks and Brand Disclaimer

Our website mentions various hardware brands (such as Headrush, Fractal Audio, Kemper, Line 6, Boss, etc.). Important: These names are used solely to indicate compatibility of the presets. Tons of Tones has no business affiliation, partnership, or association with these companies. All trademarks belong to their respective owners.

6. Limitation of Liability and User-Generated Content

Tons of Tones provides a platform for creators to share their unique presets and digital products with the music community. Because our marketplace is community-driven, the digital files are uploaded and managed directly by the individual Vendors, not by Tons of Tones.

• Provided “As Is”: We expect our Vendors to maintain high standards and deliver quality products. However, since we do not manually alter or inspect every individual file, all user-generated content and the platform itself are provided strictly on an “as is” and “as available” basis.

• Standard Digital Safety: As with downloading any digital content from the internet, we encourage you to follow standard digital safety practices. Tons of Tones does not assume liability for the performance of third-party files, loss of data, or any technical difficulties including potential damage to your musical equipment or hardware that may arise from their use.

• Disputes and Vendor Responsibility: We are not responsible for any disputes between Buyers and Vendors. By using the marketplace, you acknowledge that the respective Vendor is solely responsible for the functionality, safety, and contents of their uploaded products. Any claims regarding a specific product should be directed to the Vendor.

7. Governing Law

These Terms shall be governed by the laws of The State of Israel. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the courts of Tel Aviv-Yafo.
